Terms of Service

Effective Date: April 6, 2026


1. Acceptance of Terms

By accessing or using Read the Room (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

If you are using the Service on behalf of an organization (university, government agency, corporation, or other entity), you represent that you have authority to bind that organization to these Terms. In that case, "you" refers to both you individually and the organization.


2. Definitions

  • Service: Read the Room, including all web interfaces, APIs, real-time communication features, and related services operated by PoweredAI Solutions LLC.
  • Simulation: A structured, time-bound simulation exercise conducted on the Service. Simulations consist of one or more Rounds and involve fictional scenarios.
  • Facilitator: A registered user with an email-based account who creates, configures, and manages Simulations. Facilitators control simulation flow, author Injects, approve requests, and monitor participant activity.
  • Participant: An individual who joins a Simulation using a nickname and team join code. Participants do not create accounts. Access is limited to the duration of the active Simulation.
  • Content: All text, data, files, messages, press releases, deliverables, and other materials created, uploaded, or transmitted through the Service by users.
  • Team: A named group of Participants within a Simulation, assigned by the Facilitator.
  • Round: A discrete phase within a Simulation, typically time-bounded, during which Teams produce deliverables and respond to Injects.
  • Inject: A facilitator-authored event, directive, or information update delivered to one or more Teams during a Simulation, optionally with a response timer.

3. Eligibility

To use the Service, you must:

(a) Be at least 16 years of age, or participate under the direct supervision of an educational institution or authorized organization that has accepted these Terms on your behalf.

(b) Have the legal capacity to enter into a binding agreement, or have a parent, guardian, or institutional representative who has accepted these Terms on your behalf.

(c) Not be barred from using the Service under applicable law.

Facilitators who invite Participants under the age of 18 are responsible for obtaining any required parental or institutional consent.


4. Account Types and Registration

4.1 Facilitator Accounts

Facilitators register with an email address, password, and display nickname. Registration requires a valid invite code issued by PoweredAI Solutions LLC or an existing Facilitator with grant privileges. Facilitators are responsible for:

  • Maintaining the confidentiality of their login credentials.
  • All activity that occurs under their account.
  • Managing their Simulations, including participant access, content moderation, and data handling.

4.2 Participant Access

Participants join Simulations by entering a nickname and a team-specific join code provided by a Facilitator. Participants do not create persistent accounts. No email, password, or other identifying information is required.

Participant access is limited to the active Simulation session. When a Simulation ends, or when a Facilitator removes a Participant, access terminates. Participants may rejoin an active Simulation using the same or a different nickname, subject to Facilitator controls.


5. Description of Service

Read the Room is a web-based service for conducting fictional simulations in educational, government, and corporate training contexts.

The Service provides:

  • Real-time team communication (internal team chat, cross-team channels, press/public channels, direct messages, facilitator channels).
  • Structured exercise management (rounds, timed injects, deliverable submissions, cross-team negotiation requests).
  • Facilitator tools for simulation design, monitoring, and assessment.
  • Presence tracking and session duration tracking for active participants.
  • Data export capabilities for post-exercise review.

The Service does not provide:

  • Academic credit, certification, or formal qualifications.
  • Professional advice or consultation of any kind, including crisis-management, legal, medical, or policy advice.
  • Guaranteed uptime or real-time performance levels.
  • Storage of participant personal data beyond what is strictly necessary for platform operation (see Section 9).

6. User Content and Intellectual Property

6.1 Participant-Created Content

Participants and their Teams retain ownership of Content they create through the Service, including messages, deliverables, press releases, and cross-team communications. By using the Service, Participants grant PoweredAI Solutions LLC a limited, non-exclusive, royalty-free license to store, display, transmit, and process such Content solely for the purpose of operating and delivering the Service during the Simulation.

6.2 Facilitator-Created Content

Facilitators and their affiliated institutions retain ownership of Content they create, including simulation scenarios, role descriptions, inject text, and assessment materials. By using the Service, Facilitators grant PoweredAI Solutions LLC the same limited operational license described in Section 6.1.

6.3 Exported Data

When Content is exported from the Service (transcripts, deliverables, analytics), the exporting institution receives a non-exclusive license to use that data for educational assessment, internal review, and academic research purposes, subject to applicable privacy and data protection requirements.

6.4 Platform Intellectual Property

PoweredAI Solutions LLC retains all rights in the Service itself, including its trademarks, trade dress, source code, user interface design, underlying technology, and documentation. Nothing in these Terms transfers ownership of any platform intellectual property to any user.

6.5 No Training Use

PoweredAI Solutions LLC does not use user-created Content to train machine learning models or for any purpose beyond operating the Service, unless the user provides explicit written consent.


7. Fictional Nature of Simulations

All Simulations conducted on the Service are entirely fictional. Scenarios, roles, entities, and events depicted in Simulations do not represent real situations, organizations, or individuals unless explicitly disclosed by the Facilitator for educational context.

Users must not treat Simulation content as factual, act on it outside the exercise, or represent it to third parties as real.

8. Acceptable Use

Use of the Service is subject to the Read the Room Acceptable Use Policy. Violations may result in content removal, access suspension, or permanent termination.

9. Privacy

Collection, use, and protection of personal data is governed by the Read the Room Privacy Policy.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. PoweredAI Solutions LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Without limiting the foregoing, PoweredAI Solutions LLC does not warrant that:

(a) The Service will be uninterrupted, error-free, or available at any particular time.

(b) The Service will meet any specific educational outcomes, learning objectives, or training standards.

(c) Any defects will be corrected within a particular timeframe.

(d) Real-time features (chat, presence tracking, notifications) will operate without latency or interruption.


11. Limitation of Liability

11.1 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PoweredAI Solutions LLC'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS PAID BY YOU TO PoweredAI Solutions LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

11.2 Exclusion of Damages

IN NO EVENT SHALL PoweredAI Solutions LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, OR COST OF PROCUREMENT OF SUBSTITUTE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.

11.3 Simulation-Related Disclaimer

PoweredAI Solutions LLC IS NOT LIABLE FOR EMOTIONAL DISTRESS, PSYCHOLOGICAL IMPACT, OR DISCOMFORT ARISING FROM PARTICIPATION IN REALISTIC SIMULATION SCENARIOS. SIMULATIONS ARE DESIGNED TO BE CHALLENGING AND MAY INVOLVE HIGH-PRESSURE FICTIONAL SITUATIONS. BY PARTICIPATING, YOU ACKNOWLEDGE AND ACCEPT THIS INHERENT CHARACTERISTIC OF THE SERVICE.

11.4 Applicability

The limitations in this Section 11 apply even if a remedy fails its essential purpose and regardless of whether PoweredAI Solutions LLC has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, liability is limited to the maximum extent permitted by law.


12. Indemnification

12.1 General Indemnification

You agree to indemnify, defend, and hold harmless PoweredAI Solutions LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

(a) Your Content or your use of the Service.

(b) Your violation of these Terms.

(c) Your violation of any applicable law or regulation.

(d) Your violation of any third-party right, including intellectual property, privacy, or publicity rights.

12.2 Emergency Services and External Contact

You specifically agree to indemnify PoweredAI Solutions LLC for all costs, damages, fines, and liabilities (including legal fees) arising from your contact with real emergency services, law enforcement, media organizations, government agencies, military entities, or any other external party based on fictional Simulation content. This includes, without limitation, costs arising from false emergency reports, unauthorized media disclosures, or contact with real organizations depicted in or referenced by Simulation scenarios.

12.3 Minor Users

Where a user is under 18 years of age, the parent, guardian, or institution that authorized the user's access assumes the indemnification obligations in this Section on the user's behalf.


13. Termination

13.1 By PoweredAI Solutions LLC

PoweredAI Solutions LLC may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms or the Acceptable Use Policy.

13.2 By Facilitators

Facilitators may remove Participants from their Simulations at any time and for any reason. Facilitators may delete Simulation data at their discretion, subject to any data retention obligations of their affiliated institution.

13.3 Automatic Termination of Participant Access

Participant access to a Simulation terminates automatically when the Simulation ends or when a Facilitator removes the Participant. No notice is required.

13.4 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Content may be retained or deleted in accordance with Data Retention Policy and the Privacy Policy. Sections 6, 7, 10, 11, 12, and 14 survive termination. Sections 3.1 through 3.4 of the Acceptable Use Policy also survive termination.


14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.

14.2 Binding Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered in the State of Georgia, except for disputes that qualify for small claims court.

30-Day Opt-Out: You may opt out of binding arbitration by sending written notice to PoweredAI Solutions LLC within thirty (30) days of first accepting these Terms. The notice must include your name or, if you are a Participant who joined under a nickname, your nickname, the simulation name, and your approximate date of first access. The notice must also include the email address associated with your Facilitator account (if applicable) and a clear statement that you opt out of the arbitration provision. Send opt-out notices to info@poweredai.ai or 1950 Barrett Lakes Blvd NW, Apt 215, Kennesaw, GA 30144. Opt-out notices sent after the 30-day period are not valid.

14.3 Class Action Waiver

All disputes must be brought in an individual capacity. You waive any right to participate in a class action, collective action, or representative proceeding.


15. Modifications

PoweredAI Solutions LLC may modify these Terms at any time by posting the revised version on the Service. The "Effective Date" at the top of this document indicates the date of the most recent revision.

For material changes, PoweredAI Solutions LLC will make reasonable efforts to notify Facilitators by email at least fourteen (14) days before the changes take effect. Because Participants do not provide email addresses, Facilitators are responsible for communicating material changes to their Participants.

Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
